1. About these Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Burgerplatform website and related services (collectively, the “Platform” or “Service”).

By creating an account, logging in, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

We may update these Terms from time to time (see Section 19). The version published on the Platform at the time you use the Service applies to that use.

2. Definitions

  • Account — your registered user profile on the Platform.
  • Content — text, images, votes, comments, survey responses, chat messages, profile information, and other material you submit or generate on the Platform.
  • Mandate — your delegation of voting weight in a specific expertise area to another user for a limited period.
  • Proposal — a policy or civic document published on the Platform for discussion and voting.
  • User — any person who accesses the Platform with or without an Account.
  • Confidential Information — non-public information you access through the Platform that is marked confidential, reasonably understood to be confidential, or described in Section 9.

3. The Service

Burgerplatform is a civic-engagement platform that enables registered users to participate in public debate on proposals, vote, comment, maintain a citizen profile, declare expertise, select personal values, delegate mandates, and use an AI-powered chat assistant including optional structured surveys.

Certain features require you to be logged in. The Platform is intended for civic participation and information. It does not constitute official government communication unless explicitly stated for a specific proposal.

4. Eligibility

You must be at least 16 years old (or the minimum age required in your jurisdiction) to create an Account and use interactive features. You represent that the information you provide is accurate and that you have the legal capacity to enter into these Terms.

5. Accounts and Authentication

5.1 Registration

You may register using email and password (with email verification), third-party sign-in (Google, and where enabled Microsoft or LinkedIn), or partner sign-in (CMS bridge). Optional fields such as name and Dutch postcode may be used to personalise your experience.

5.2 Account security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. Notify us promptly at info@burgerplatform.net if you suspect unauthorised access.

5.3 One person, one Account

Unless we expressly permit otherwise, each individual may maintain only one Account. You may not impersonate another person or misrepresent your identity or expertise.

6. Profiles, Expertise, Values, and Mandates

You may add profile details visible to other logged-in users. Expertise declarations must reflect genuine knowledge or experience. Mandates expire automatically after the configured period (currently 180 days) and may be revoked at any time. You cannot mandate to yourself.

Personal values you select are used to personalise proposal listings and are not displayed on your public profile by default.

7. Proposals, Voting, Comments, and User Content

Each user may cast one vote per proposal (voor or tegen), subject to mandate weighting rules. Comments must not be unlawful, defamatory, harassing, hateful, threatening, obscene, or infringing.

By submitting Content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, reproduce, and process that Content solely to operate and improve the Service. You retain ownership of your Content.

8. AI Chat Assistant

The Platform includes an AI-powered chat feature provided in part through Google Gemini or similar AI services. Responses are generated automatically and may be inaccurate, incomplete, or outdated. They are for general information and civic engagement only and do not constitute professional advice.

Chat conversations may be stored and transmitted to third-party AI providers. See our Privacy Policy for details. You may not use the Chatbot to generate unlawful content or bypass security controls.

9. Confidentiality, Reporting, and Platform Protection

9.1 Confidential information

Not all information you encounter is public. You agree to keep Confidential Information confidential and not disclose it outside the Platform except as necessary for normal authorised use, with our prior written consent, or as required by law.

9.2 Report issues and complaints to us first

If you discover a problem relating to the Platform, you must contact us first at info@burgerplatform.net (or info@burgerplatform.net for security matters) before sharing it publicly or with third parties outside the Platform.

9.3 Do not harm Burgerplatform

You must not take any action that harms, disrupts, undermines, or damages Burgerplatform, our partners, or other users.

9.4 Duty to share relevant findings

If you become aware of information that could reasonably affect the security, integrity, or lawful operation of the Platform, you must report such findings to us promptly and not ignore or withhold them.

10. Acceptable Use

You agree not to violate applicable law, infringe rights of others, upload malware, scrape data without authorisation, harass other users, spam the Service, manipulate voting outcomes, or breach Section 9.

11. Third-Party Services

The Platform integrates with third-party services including Google, Microsoft, LinkedIn (authentication), Google Gemini (AI chat), PDOK Locatieserver (postcode validation), and partner CMS systems. Your use may be subject to their own terms.

12. Intellectual Property

The Platform software, design, branding, and original content we create are owned by or licensed to Burgerplatform. Proposal documents may be authored by partners or third parties; hosting does not transfer ownership to you.

13. Privacy

Your personal data is processed in accordance with our Privacy Policy and applicable data protection law (including the GDPR/AVG where applicable).

14. Service Availability and Changes

We strive to keep the Platform available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Burgerplatform shall not be liable for indirect or consequential damages. Our total aggregate liability shall not exceed €100 or the amount you paid us in the preceding twelve months, whichever is greater.

17. Indemnification

You agree to indemnify and hold harmless Burgerplatform from claims arising from your Content, your use of the Platform, or your violation of these Terms.

18. Suspension and Termination

We may suspend or terminate your access if you breach these Terms or to protect the Platform or other users. You may stop using the Platform at any time.

19. Changes to these Terms

We may update these Terms and publish the updated version on https://burgerplatform.nl. Continued use after the effective date constitutes acceptance.

20. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts in the Netherlands, unless mandatory consumer protection rules require otherwise.

21. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us. If any provision is invalid, the remainder remains in effect.
